Consultation among the lead federal agency and other participants in the Section 106 process listed below allows the federal agency to consider historic preservation implications of proposed undertakings prior to committing to a course of action.

Participants in the Section 106 process include:

  • Lead federal agency responsible for Section 106 compliance
  • Other federal agencies affected by the undertaking
  • Advisory Council on Historic Preservation
  • State Historic Preservation Officers
  • Indian tribes
  • Local governments
  • Applicants for Federal assistance (including approvals)
  • Other individuals/organizations with interest due to the nature of their legal or economic relation to the project or affected properties, or their concern with the project’s effects on historic properties at the discretion of the lead agency

Consulting parties typically perform some or all of the following functions:

  • Share concerns and priorities regarding historic properties potentially affected by proposed undertaking
  • Provide information regarding historic properties
  • Review and comment on technical analyses related to the undertaking
  • Recommend and consider ways to avoid, minimize, or mitigate adverse effects to historic properties
